One of the most common problems is that a rogue agency will issue an inappropriate model release form. First of all, what is a model release form? The model release form is the contract between a model and the photographer or client that determines how the images or production can be used. Therefore, as with any contract, Models Direct advises that you thoroughly read and reread the form before signing it. It is a good idea to have someone else read it as well, especially if you happen to have a lawyer in the family!
When a new model starts out they may feel like they can’t question a model release form or modelling contract through fears that they will either be refused by the client, be branded as a troublemaker and not get any more work. ‘Scam’ agencies may use this against the model and construct a contract that takes away the model’s rights to the images, or allows them to be misused.
For example, this misuse could involve the photos being placed on sordid or inappropriate websites, something that could be ultimately detrimental to a model’s career. However, the photographer will most likely be allowed to enlarge negatives, manipulate the photographs and use computer software to enhance the quality of the images.
If you fear there is a chance that you are being taken advantage of, seek advice on having the model release form amended so that if the images are misused you have some protection. A clause in the contract is a provision that can be amended, added or removed, and can be used by models to clear up any problems that could arise in the future.
