The client had bought a fresh soup in a plastic container from the chilled produce department of the supermarket. On return home she had frozen the soup following the instructions on the back of the container.
One month later after reheating in a microwave the container collapsed inwards covering the client’s hand in the soup.
The client had prior to seeking advice from Fentons been offered a £20.00 gift voucher as a gesture of goodwill.
In addition to the client’s physical injuries, she was prevented from showing her St. Bernard at Crufts 2008. An alternate showed the dog for her resulting in a lower placing in class than had been achieved in 2007. Fentons are advising upon the potential loss of Stud Fees arising from the lower placing.
The supermarket offered a goodwill payment of £20.00. The injury is worth substantially more than that. In addition the losses arising from the loss of breeding fees are going to be substantial.
